Clearview Farm Terms and Conditions

Introduction

These Terms and Conditions apply to all visitors, clients, boarders, riders, and participants in activities at Clearview Farm, a professional equestrian facility in Rowley, Massachusetts. By scheduling a visit, boarding a horse, taking lessons, training, buying or leasing a horse, or otherwise participating in farm activities, you agree to these terms.

Clearview Farm may update these Terms and Conditions at any time without prior notice.


Appointments and Farm Access

All visits to Clearview Farm must be scheduled by appointment. This is required for safety and proper coordination of activities.

Visitors without appointments are not permitted on the property.


Massachusetts Equine Activity Liability Law

Under Massachusetts General Laws Chapter 128, Section 2D, an equine professional or activity sponsor, including Clearview Farm, is generally not liable for injury or death of a participant that results from the inherent risks of equine activities. These inherent risks include the unpredictable nature of horses, surface conditions, collisions, and other risks that are naturally part of working with horses. (Massachusetts General Court)

This limitation of liability applies except in limited situations where the equine professional’s actions meet specific exceptions in the statute, such as:

  • Providing faulty equipment or failing to assess a participant’s ability to safely manage a horse provided.
  • Failing to post required warning signs or warn of known dangerous conditions.
  • Acts of willful, wanton, or reckless disregard for safety. (Massachusetts General Court)

Clearview Farm will post and maintain any required warning signs and require appropriate signed participant waivers.


Assumption of Risk

Horses are inherently unpredictable and may behave in ways that result in harm. By participating in any equine activity at Clearview Farm, including riding, handling, grooming, or simply being near horses, you voluntarily assume all risks associated with those activities.

This assumption of risk applies regardless of whether activities occur on or off the farm.


Boarding and Horse Care

Boarding agreements are required for all horses kept at Clearview Farm.

While Clearview Farm strives to provide attentive care and consistent routines, we are not responsible for injury, illness, loss, or death of any horse, regardless of cause.

Horse owners must maintain current vaccinations, deworming, and general health care as required. Veterinary, farrier, or emergency care costs are the responsibility of the horse owner.

Under Massachusetts General Laws Chapter 255, Section 24, Clearview Farm may hold a lien on animals boarding on the premises for unpaid boarding charges. (Massachusetts General Court)


Instruction, Training, and Lessons

Participation in lessons, training sessions, or instruction is voluntary and undertaken at your own risk. Clearview Farm is not liable for accidents, injuries, or damages that occur during lessons, training, or riding.

Lesson and training rates, scheduling, and cancellation policies are governed by individual agreements.

Participants may be required to sign a liability waiver before beginning lessons or training.


Horses for Sale and Trainer as Agent Services

Clearview Farm may assist clients in buying or selling horses and may act as a trainer or agent to help find the right match.

Clearview Farm does not guarantee the performance, soundness, temperament, or suitability of any horse. Final responsibility for horse purchase or lease decisions rests with the buyer or lessee.

Veterinary exams, transportation, and purchase agreements are the responsibility of the buyer unless otherwise agreed in writing.


Liability Waivers and Insurance

All clients and participants may be required to sign waivers acknowledging the risks associated with equine activities.

Horse owners and riders are encouraged to maintain personal liability and equine insurance, including coverage for care, custody, and control where applicable.


Governing Law

These Terms and Conditions are governed by the laws of the Commonwealth of Massachusetts.
